These Terms govern your use of the website at theexperiencesuite (the "Site") and the apps offered through it — MyKindra, Heard & Noted, and Journey Studio (each an "App", together the "Service"). The Service is provided by Perfect Your CX, based in New York, United States ("we", "us"). By using the Service you agree to these Terms.

1. Accounts

You need an account to use most parts of the Service. You're responsible for keeping your login details safe and for everything that happens under your account. Tell us at hello@perfectyourcx.com if you suspect any unauthorised use.

2. Plans, lifetime access and top-ups

Some Apps offer a lifetime plan during an introductory window. When an App reaches its lifetime goal, that window closes and the App moves to a subscription model. Lifetime access purchased before that point continues under the terms described on the App's page at the time of purchase.

Top-up packs for AI or voice usage do not expire and can be used at any time on the App they were bought for. Allowances included with a plan reset on the schedule described on the App's page.

3. Payments and refunds

Prices are shown on each App's page and are charged in the currency listed at checkout. Taxes may be added depending on your location. Because digital products are delivered immediately, refunds are handled case-by-case — write to us within 14 days of purchase and we'll do our best to make it right.

4. Acceptable use

Please don't use the Service to:

  • break the law or harm other people;
  • upload content you don't have the right to share;
  • attempt to access accounts, data, or systems that aren't yours;
  • reverse-engineer, scrape, or resell the Service without our written permission.

5. Your content

You keep ownership of the content you put into the Apps (notes, recordings, customer data, etc.). You grant us a limited licence to host, process and display that content solely so we can provide the Service to you. We don't sell your content and we don't use it to train third-party AI models.

6. Our content

The Site, the Apps, and everything we create around them — copy, design, code, brand — belong to Perfect Your CX and are protected by copyright and other laws. See our Copyright notice for details.

7. Availability

We aim to keep the Service running smoothly but we don't guarantee uninterrupted availability. We may change, suspend, or discontinue parts of the Service, and we'll give reasonable notice when we do.

8. Disclaimers and liability

The Service is provided "as is". To the fullest extent permitted by law, Perfect Your CX is not liable for indirect or consequential losses, lost profits, or loss of data arising from your use of the Service. Nothing in these Terms limits liability that can't be excluded under applicable law.

9. Termination

You can stop using the Service at any time. We can suspend or close accounts that breach these Terms or that put the Service or other users at risk.

10. Governing law

These Terms are governed by the laws of the State of New York, USA. Disputes will be handled by the courts located in New York County, New York, unless your local consumer law gives you a different right.

11. Changes

We may update these Terms from time to time. Material changes will be announced on the Site and the "Last updated" date above will change. Continuing to use the Service after an update means you accept the new Terms.
